Acceptance of Terms:
By using the service of the e-Payment Gateway from Ministry of Transport, Communications and Information Technology (MTCIT) at this web site, you agree to accept the clauses for terms of use as detailed below, as well as the privacy policy which MTCIT adopts and publishes for its service. -
Indemnification:
You agree to indemnify, defend and hold MTCIT and its business partners, staff and affiliates harmless from any liability, loss, claim and expense, including reasonable attorneys' fees and expenses, related to either your violation of these Terms of Use or your use of the Gateway services. -
Governing Law:
The Terms of Use agreement shall be governed and construed in accordance with the laws of the Sultanate of Oman. -
Inapplicability of any MasterCard, Visa, Dinners or Amex-branded Payment Card Cardholder Agreement:
Ministry of Transport, Communications and Information Technology (MTCIT) is NOT a financial institution and does not issue credit, debit, check or payment cards of any type of nature. Your MasterCard, Visa, Dinners or Amex-branded payment card relationship is with an issuing bank or financial institution, and not with MTCIT. Any and all questions or issues regarding your MasterCard, Visa, Dinners or Amex-branded payment card or cardholder account should be directed to the bank or financial institution that issued your card, and not to MTCIT. While MTCIT likewise has a relationship with your bank or financial institution, that relationship does not pertain to individual cardholders or payment card accounts. -
Age And Responsibility:
You represent that you are of sufficient legal age to use the e-Payment Gateway and to create binding legal obligations for any liability you may incur as a result of the use of e-Payment Gateway. You understand that you are financially responsible for all uses of the e-Payment Gateway by you and those authorized by you to use your financial Data, your password or other verification information. -
Your Personal Information:
You agree that you are solely responsible for maintaining your personal information such as card number, PIN, address, which may be required to provide in the use of the e-Payment Gateway service, under strict security and confidentiality. MTCIT shall handle the information by following the MTCIT privacy policy for this service, and MTCIT shall not be liable or made responsible for any claim of loss or compromising of any of your personal information. -
No responsibility of handling enquiry or complaint:
MTCIT is a payment service provider to the merchant selling goods or service online and does not bear a relation of any other kind with the merchant including the goods and service provided by the merchant. MTCIT shall neither receive nor provide any response to any enquiry, complaint, or request of information which are sent verbally or written through any means to MTCIT from you arisen or caused as a result of the use the merchant service.
Similarly MTCIT does not bear any relation to the issuing bank of your card or payment instrument. MTCIT shall neither receive nor provide any response to any enquiry, complaint, or request of information from you with regards to your banking transactions or card status in relation to the online purchase and use of the e-Payment gateway service.
MTCIT shall only provide response to enquiries from the online merchant or banks in accordance to their respective agreement to MTCIT with regards to the use of MTCIT service. -
Copyright:
All content on the MTCIT e-Payment Gateway web pages, such as text, logo, graphic, image, software, are the property of MTCIT or its content provider. These information are protected by the copyright of their respective owner. Any oneThe user is strictly prohibited to reproduce or edit any of such information without express permission from MTCIT. -
No liability:
a). MTCIT shall not be liable for any loss resulted or claim of non-fulfilling of services or goods which the user purchase from online merchants. MTCIT shall not be contacted or held liable to attend any case of dispute resolution purchaser and the merchant over any subjects relating to the provision of services and use of services provided by the merchants.
b). MTCIT shall not be liable for any claim of loss or damage due to chargeback or fraud transaction arising from the your bank cards or banking accounts after you have accessed or used the e-Payment gateway service. The MTCIT e-Payment Gateway handles all user information and data in accordance which the privacy policy and is compliant with the applicable industrial standards. -
No Warranty:
MTCIT does not provide any warranty that this site; information, content, materials, products (including software) or services included on or otherwise made available to you through this site; their servers; or e-mail sent from the merchant or MTCIT are free of viruses or other harmful components. the service is provided on an "as is" and "as available" basis. MTCIT expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. MTCIT makes no representations or warranties and shall not be liable for any damage of any kind arising from the use of this site or the information, content, materials, products (including software) or services included on or otherwise made available to you through this site. you expressly agree that your use of this site is at your sole risk.
MTCIT make no warranty that (i) the service will meet your requirements; (ii) the service will be uninterrupted, timely, secure or error-free; (iii) the results that may be obtained from the use of the service will be accurate or reliable; (iv) the quality of any products, services, information or other material purchased or obtained by you through the service will meet your expectations; and (v) any errors in the software will be corrected.

We may only share your personal information under exceptional situation such as the need being requested by Law enforcement, government department, court order or similar legal procedure. We need to do so to comply with law in the Sultanate of Oman. We believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity.
